SINGLE USE LICENSE (*SUL*), MULTI USE LICENSE (*MUL*) and ENTERPRISE LICENSE (*EL*).

NOTICE TO USERS: PLEASE READ THIS SOFTWARE LICENSE AGREEMENT (*License*) BEFORE PURCHASING THE SOFTWARE. BY PURCHASING THE SOFTWARE YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS *License*. IF YOU DO NOT AGREE TO THE TERMS OF THIS *License* , DO NOT PURCHASE THIS SOFTWARE.

IMPORTANT NOTE: This software is licensed to you only for reproduction of materials you are authorized or legally permitted to reproduce.

1. General.The software *Uphotogallery* and any documentation accompanying this *License* are licensed, not sold, to you by *Uapplication* for use only under the terms of this *License*, and *Uapplication* reserves all rights not expressly granted to you. The rights granted herein are limited to *Uapplication*'s intellectual property rights in the *Uphotogallery* Software and do not include any other patents or intellectual property rights. You own the media on which the *Uphotogallery* Software is recorded but *Uapplication* retains ownership of the *Uphotogallery* Software itself. The rights granted under the terms of this *License* include any software upgrades that replace and/or supplement the original *Uphotogallery* Software product, unless such upgrade contains a separate license.

2. Permitted License Uses and Restrictions.

THIS *License* IN *SUL* MODALITY ALLOWS YOU TO INSTALL, VIEW AND USE THE *UPHOTOGALLERY* SOFTWARE ON ONLY ONE (1) WEB ADDRESS (URL).
THIS *License* IN *MUL* MODALITY ALLOWS YOU TO INSTALL, VIEW AND USE THE *UPHOTOGALLERY* SOFTWARE ON NOT MORE THAN TEN (10) URL.
THIS *License* IN *EL* MODALITY ALLOWS YOU TO INSTALL, VIEW AND USE THE *UPHOTOGALLERY* SOFTWARE ON UNLIMITED URLs.

You may modify source code (at your own risk), but the software (altered or otherwise) may not be rent or distributed to entities beyond the *License* holder. You may not create derivative works of the *Uphotogallery* Software. You may not pass off the whole or any part of the *Uphotogallery* software as your own work (this behavoir shall constitute violation of copyright laws). You may not deactivate, change, remove, all or any hyper links or links to *Uapplication* and the *Uapplication* powered by logo's, text, or images. You will keep all copyright notices intact, including the notices embedded in all parts of the *Uphotogallery* Software.

3. Transfer.You may not rent, lease, lend or sublicense the *Uphotogallery* Software or redistribute itself for profit or for Free.

4. Disclaimer of Warranties.YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE *UPHOTOGALLERY* SOFTWARE IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU. THE *UPHOTOGALLERY* SOFTWARE IS PROVIDED "AS IS", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. *UAPPLICATION* DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE *UPHOTOGALLERY* SOFTWARE, THAT THE FUNCTIONS CONTAINED IN THE *UPHOTOGALLERY* SOFTWARE WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE *UPHOTOGALLERY* SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE *UPHOTOGALLERY* SOFTWARE WILL BE CORRECTED.

5. Limitation of Liability. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL *UAPPLICATION* BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER DUE TO THE *UPHOTOGALLERY* SOFTWARE.

6. Violation of Terms Agreement. If any terms are violated, *Uapplication* reserves the right to revoke the *License* at any time. No refunds will be granted for revoked licenses. Any disagreement which may arise between the parties with regard to the interpretation and/or execution of the present contract shall by default come under the jurisdiction of the Italian Courts.

7.*Uapplication* reserves the right to modify these terms at any time without prior notice.

This License Agreement is governed by the laws of Italy and EC.

Uphotogallery System Requirements

Server Requirements

Uphotogallery has been developed to run exclusively on web sites hosted on Windows Servers with Internet Information Server 4.0 or higher and ASP 3.0 installed. No other Platforms are supported.

Database Requirements

Uphotogallery supports both Microsoft Access and Microsoft Sql Server databases.

Components

This application supports a wide range of 3rd party components : JMAIL, ASPEMAIL, ASPMAIL, CDONTS ( default on Windows 2000 Server; disable on Windows 2003 Server ), CDOSYS ( default on Windows 2000/2003 Server ), for sending email. For Uploading file and image no Components are required, Uphotogallery comes with its own Upload Script.

This application uses Javascript, COOKIES ( client side ) and FilseSyStemObject ( server side ) extensively.

Uphotogallery has been tested with IE5.0+, NS6+, Mozilla 1.4+ and Opera 7.21+.
